Conditions Relating to the Sale of Products to You

This section deals with conditions relating to the sale of products by cleanercities.co.uk to you our customer.
Our contract

When you place an order to purchase a product from cleanercities.co.uk, we will send you an e-mail confirming receipt and details of your order. Your order represents an offer to us to purchase a product, which is accepted by us when we send e-mail confirmation to you that we've dispatched that product to you. That acceptance will be complete at the time we send the e-mail to you. Any products on the same order, which we have not confirmed in an e-mail to have been dispatched, do not form part of that contract.

Returns

Our "No Hassle" guarantee means that if for any reason you are unhappy with your purchase, you can return it to us in its original condition within 30 days of the date you received the item. You must email us before you send the item back. To enable us to process the return as quickly as possible, quote your order number and the reason for the return in the e-mail form. Your order will contain instructions for return. Please return any items in original packaging with compliments slip showing order number / customer number.

In addition to your 30-day "No Hassle" returns right, you are, by law, entitled to a statutory cooling-off period of seven business days. This applies to all of our products. For your protection, we recommend that you use a recorded-delivery service. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error, or if the item is faulty.

You should be aware that once we begin the delivery process you would not be able to cancel any contract you have with us for additional services carried out by us. As soon as we receive notice of your cancellation of this order, we will refund the relevant part of the purchase price for that item together with the item's normal postage charge. We cannot refund any recorded or special delivery postage charge. We list availability information for products sold by us on the web store, either on confirmation of order or as included on each product information page.

Customs

When ordering goods from cleanercities.co.uk for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be.

Customs policies vary widely from country to country, so you should contact your local customs office for further information. Additionally, please note that when ordering from cleanercities.co.uk you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Your privacy is important to us and we know that you care about how information about your order is used and shared. We would like our international customers and customers dispatching products internationally to be aware that cross-border deliveries are subject to opening and inspection by customs authorities.

Health & Safety

Certain products within our catalogue have properties that make them potentially unsafe if misused. PLEASE TAKE CARE & EXERCISE COMMON SENSE WHEN USING OUR PRODUCTS. You must, upon receipt of any such product, read carefully any safety warnings and follow clearly any guidelines on how to use the product. If you are in any doubt about the use of the product, the meaning of any warnings, or whether your intended use of the product is safe, we urge you to contact the manufacturer for clarification prior to use.

cleanercities.co.uk will not be held responsible for any negligent use or misuse of products purchased from our web store. Nothing in these guidelines should be thought to supersede, or to alter, or to take precedence over manufacturers' instructions. If no instructions are issued and you have a query about how to use the product you are purchasing, we request that you consult the manufacturer or email us.

Conditions relating to your use of cleanercities.co.uk and sales to you our customer - Individuals

Children

cleanercities.co.uk does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use cleanercities.co.uk only with the involvement of a parent or guardian we can accept payments  by telephone for one individual litterbin. The call or SMS will cost £6.00 including delivery and service charges. We recommend that you do not use this method if you have the means to pay by credit debit card or cheque. We can also arrange direct cash payment into any Barclays Bank. If you have online banking with any UK bank you may pay us electronically. Please contact us for sort code, account and reference numbers.

Electronic communications

When you visit cleanercities.co.uk or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the web store. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Losses

cleanercities.co.uk will be responsible for any losses you suffer as a result of us breaching these conditions, if the losses were reasonably foreseeable to both you and us when you commenced using the web store, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the web store or when a contract for the sale of goods by us to you was formed. cleanercities.co.uk does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty.

Alteration of Service or Amendments to the Conditions

We reserve the right to make changes to our web store, policies, and these Conditions of Use & Sale at any time. You will be subject to the policies and Conditions of Conditions of Use & Sale in force at the time that you use the web store or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights.

Governing law and jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.

Conditions relating to your use of cleanercities.co.uk and sales to you our customer - Corporate Orders  

Any customised orders with a value of £1000 or more are subject to a 15% non refundable deposit - payable when ordering. The full balance is payable within 7 days of delivery. Failure to clear outstanding balances will result in penalty charges of £50 per week being added to your balance. We are raising monies to fund an advice service and cancelled customised orders means additional costs are incurred by cleanercities.co.uk which means less resources available to us.  

We choose shipping as our preferred mode of delivery. It can take approximately 6 weeks for goods to be delivered to ourselves in the UK. So what if it takes so long - the emissions are much less than that of air transport! We therefore insist that you must allow a minimum of 8 weeks for delivery for customised orders over £1500.

Terms and Conditions for account holders at Cleanercities.co.uk

1. Goods shall remain the property of the seller as legal and equitable owner until the buyer has paid the full purchase price to the seller.

2. The seller may, for the purpose of recovery of its goods, enter upon any premises where they are stored or where they are reasonably thought to be stored and may repossess the same.

3. The contract between the buyer and the seller shall in all respects be construed and operate as an English contract governed by English Law.

4. For individual personal orders payment must be received in full before goods are dispatched. For corporate or wholesale orders payments are to be made in full to Cleanercities.co.uk within 7 days of the date of the invoice.

5. In the event of payment of any invoice remaining outstanding for more than 60 days, Cleanercities.co.uk, reserve the right to charge an administration fee being 10% plus the bank of England Reference rate, for the costs involved in collecting the outstanding monies.

6. In the event of non-payment the account will be placed on stop credit until such time as the monies owed to the seller are paid.

7. Discounts and offers are made at the discretion of Cleanercities.co.uk

8. In the event of non-payment for longer than 120 days Cleanercities.co.uk reserve the right to seek legal action through the English civil courts..

Funding

Cleanercities.co.uk has pledged to use profits to fund an environmental and ecological advice service aimed at community and voluntary groups..

Although we have been on the web since 29th September 2004 - we started up as a new enterprise on World Environment Day (5th June 2005).
